Refund Policy

At Loud and Visible Marketing, we are committed to client satisfaction while operating within the bounds of professional marketing standards and North Carolina law. This policy outlines your rights as a client and our obligations as a marketing agency under the North Carolina Unfair and Deceptive Trade Practices Act (G.S. § 75-1.1).

By purchasing any service, digital product, or promotional material from Loud and Visible Marketing, you agree to this Refund Policy in full.

Eligibility for Refunds

Refunds may be approved under the following specific conditions:

You received a damaged or incorrect product, and proper documentation is provided.

You paid for a service that was not delivered or was delivered in a materially different way than described.

A payment was processed in error or you were billed after cancellation, provided you can show proof of cancellation before the billing cycle.

All refund requests must be submitted within 7 calendar days of receiving the product or service unless otherwise stated in your client agreement. We reserve the right to verify all claims before approving a refund.

Non-Refundable Conditions

The following are strictly non-refundable, consistent with business practices and North Carolina state law:

Completed marketing services, including but not limited to flyer drops, campaign setup, brand ambassador outreach, or social media content production.

Digital goods (templates, digital ads, marketing plans) once delivery or access has been provided.

Services performed on expedited timelines or with pre-paid discounts.

Any change-of-mind requests, client-side schedule conflicts, or missed deadlines caused by lack of communication.

Custom print orders, merchandise, or event-based services that were already sent to production or completed.

Failure to use the service for any reason not caused by Loud and Visible Marketing.

Refund Process

If your refund request is approved:

Refunds are issued to the original payment method within 10–15 business days.

Any shipping, printing, third-party platform, or payment processing fees are non-refundable unless the issue was due to our error.

Loud and Visible Marketing reserves the right to issue store credit or a partial refund at our sole discretion when full refunds are not warranted.

Chargebacks and Fraudulent Disputes

Filing a chargeback or dispute through your payment processor without first contacting Loud and Visible Marketing is considered a breach of this agreement.

If a dispute is filed without following our internal refund process:

We reserve the right to suspend all services,

Report the matter to payment processors and credit reporting entities as fraud or misuse,

Pursue civil remedies including collection of damages and legal fees.

Limitation of Liability (North Carolina-Compliant)

To the fullest extent permitted by law under North Carolina General Statutes, Loud and Visible Marketing shall not be held liable for:

Any indirect, incidental, punitive, or consequential damages,

Loss of revenue, customers, or reputation due to delays or service interruption,

Client failure to provide timely information, materials, or approvals necessary to execute services.

Our total liability shall never exceed the amount paid for the disputed service or product.

 Governing Law & Dispute Resolution

This policy shall be governed by and construed under the laws of the State of North Carolina. All disputes will be resolved in the courts located in Wake County, NC, or the nearest competent jurisdiction to our primary business operations.

By doing business with Loud and Visible Marketing, you waive any right to class action proceedings and agree to resolve disputes individually.

Modifications to This Policy

Loud and Visible Marketing may update or modify this policy at any time, and all changes become effective immediately upon being posted on our website. It is your responsibility to review this policy before making a purchase.

Continued use of our services after policy changes constitutes your acceptance of the revised terms.
